Waiver of Liability & Assumption of Risk

By engaging the services of DARK UAS LLC ("DARK UAS"), you ("Client") acknowledge and agree to the following terms. This waiver is intended to protect both parties by clearly outlining the risks, responsibilities, and limitations associated with unmanned aerial systems (UAS) operations.

1. Assumption of Risk

The Client understands that UAS operations, including but not limited to aerial photography, videography, surveying, and tactical operations, involve inherent risks, including but not limited to:

• Uncontrollable environmental factors (e.g., wind, weather, wildlife).
• Potential damage to property due to unforeseen circumstances.
• Temporary or permanent loss of UAS communication.
• Regulatory or operational restrictions imposed by airspace authorities.

The Client voluntarily assumes all risks associated with the requested UAS operation and waives any claims against DARK UAS for losses arising from these inherent risks.

2. Limitation of Liability

DARK UAS and its personnel shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from UAS operations, except in cases of gross negligence or willful misconduct. This includes, but is not limited to:

• Loss of data due to unforeseen technical failures.
• Minor injuries or property damage caused by airborne debris.
• Government-mandated mission cancellations or delays.

3. Compliance with FAA & Airspace Regulations

DARK UAS is committed to full compliance with the Federal Aviation Administration (FAA), local/state regulations, and any additional airspace restrictions applicable to each operation. Clients acknowledge:

• All UAS flights will be conducted in FAA-approved airspace with proper authorizations.
• No flights will be conducted in restricted areas without explicit regulatory approval.
• Clients are responsible for securing permissions from property owners or any third parties affected by the operation.

4. Data Protection & Confidentiality

DARK UAS follows industry standards for data security, encrypted storage, and client confidentiality. Clients acknowledge that:

• Aerial footage, maps, and reports will be securely stored and delivered only to authorized recipients.
• DARK UAS does not sell or distribute client data without explicit written consent.
• For highly sensitive projects (e.g., government contracts), DARK UAS is open to signing NDAs and implementing additional data security protocols.

5. Indemnification

The Client agrees to indemnify and hold harmless DARK UAS, its officers, employees, and affiliates from any claims, damages, or losses arising from:

• Client-provided false or misleading information that affects mission safety.
• Unauthorized use of aerial footage or data outside of agreed-upon terms.
• Third-party disputes, including but not limited to privacy claims.

6. Acknowledgment & Agreement

By engaging in services provided by DARK UAS, the Client acknowledges that they have read, understood, and agreed to this waiver. Clients affirm that they are authorized to enter into this agreement on behalf of themselves or their organization.
